A failed test or refusal does not have to end a driving career. DOT rules set out a path back to work. It takes time and it has to be followed in order.
The steps
- Stop safety-sensitive work. The driver is removed right away.
- See a substance abuse professional (SAP). The SAP does an evaluation and recommends education or treatment.
- Complete the SAP’s plan.
- Follow-up evaluation. The SAP confirms the plan was completed.
- Return-to-duty test. This test is directly observed, and the result must be negative.
- Follow-up testing. The SAP sets a schedule of unannounced tests after the driver returns.
The Clearinghouse
Violations and return-to-duty progress are recorded in the FMCSA Clearinghouse. Employers see them when they run a full query.
For employers
- You do not have to rehire a driver who had a violation.
- If you do, the driver must finish the steps above first.
- Keep the follow-up testing schedule confidential and on track.
